New Mexico Community and Environmental Groups Thank Their Federal Delegation for Standing up to Congressional Gutting of Waste Emissions Charge
Santa Fe, N.M – Today, the Senate voted along party lines 52-47 to pass a Congressional Review Act (CRA) resolution that will create confusion for operators as the CRA only repeals the implementation portion of the Environmental Protection Agency’s methane polluter fee (also known as the Waste Emissions Charge) while the other parts remain required by law. The program is a part of the Methane Emission Reduction Program (MERP) codified into law by former President Biden to protect our families and communities from harmful air pollution through the Inflation Reduction Act of 2022.
Yesterday, the House voted 220-206, which included support from several Democrats, and the CRA resolution is now headed to President Trump to sign, creating uncertainty for the years of work that environmental advocates and communities in New Mexico have pushed so hard for to address wasteful methane emissions released during production that directly contribute to poor air quality and impact public health. The methane polluter fee is only charged to oil and gas companies that report excess emissions based on thresholds aligned with industry-set targets. The fee is an important part of the program which incentivizes the fixing of leaks, adoption of zero-emission technology, reducing routine flaring, and more closely monitoring facilities. EPA estimated that the Waste Emissions Charge in its full form would have cut over a million metric tons of methane by 2035, making a huge impact to rein in methane waste from oil and gas operations and offering a powerful opportunity to create jobs in a growing clean energy sector.
Though several Democrats joined with Republicans to pass the CRA, the entire New Mexico delegation voted against the attack and opposed another giveaway to industry polluters. In response, advocates thanked the delegation for putting people over polluters.
